MANITOWOC, WI (WTAQ-WLUK) – After more than nine hours of deliberations, the jury in the Timothy Hauschultz trial sent two questions to the court Wednesday afternoon.
Hauschultz is facing six charges related to the death of Ethan Hauschultz, his great nephew, who was in his care in 2018 at the time of the 7 year old boy’s death.
The first question was,
When transporting an individual to the hospital in a vehicle other than emergency vehicles and after rendering first aid, would that be considered necessary medical care?
And the second question was,
What constitutes “care” and what constitutes “necessary medical care”?
Both the prosecution and defense agreeing the response to the first question was for the jury to rely on their collective memory from the trial and the jury instructions they have in their deliberations.
With regard to the second question about “care” and “necessary medical care” the sides agreed to respond with a statutory definition of necessary care.
It reads,
Necessary care as follows is care that is vital to the needs of a child’s physical emotional or mental health based on all of the facts and circumstances bearing on the child’s need for care including the child’s age the child’s physical mental or emotional condition and any special needs of the child
And for “care,” the jury was again directed to rely on their collective memory and jury instructions.
